I. Application of the General Terms and Conditions (T&C)

1. The sales terms and conditions listed below apply only to orders through the online shop of AMT EXPORT. The contract with the online store amtexport.eu is a distance contract.
2. These Terms apply to any offer and Agreement between AMT EXPORT and a Customer, unless explicitly deviated from by the parties in writing.
3. These Terms explicitly do not apply to agreements with natural persons who do not act in the exercise of their profession or business.
4. The applicability of any purchasing or other terms and conditions of the Customer is expressly rejected.
5. If one or more provisions in these Terms are wholly or partially void or nullified at any time, the remaining provisions in these Terms remain fully applicable.
6. AMT EXPORT reserves the right to amend these terms at any time and without prior notice. However, such amendment does not apply to orders placed before the revised terms are published on this website.
7. This Agreement is governed by Belgian law.

II. Registration on AMT EXPORT

1. You can create a customer account on AMT EXPORT. When creating a customer account on AMT EXPORT, you will be asked to register and enter your personal information.
2. When entering your personal information required for registration, you are responsible for ensuring that it is accurate and complete. You are obliged to treat the personal access data confidentially and not to make it accessible to unauthorized third parties. Registration confirmation follows immediately after it is sent.
3. You can also place orders for goods on AMT EXPORT as a guest. Unfortunately, due to logistical and technical reasons, it is currently only possible to make limited guest purchases at AMT EXPORT.

III. Products/Offers

1. The Products offered for sale are the Products available at the time of confirmation and payment of the order by the Customer.
2. AMT EXPORT reserves the right to change its offer at any time by adding, modifying, or removing Products.
3. Images are purely illustrative and decorative and may contain elements not included in the price or item.
4. The offer is valid while stocks last and may be changed at any time by AMT EXPORT.
5. AMT EXPORT reserves the right to refuse orders, without any justification, in case of (non-exhaustive) abuse of rights, commercial use, resale, abnormal quantities, stock depletion, invalid offer, or force majeure.

IV. The Agreement

1. The presentation of the products on our online boutique does not constitute a legally binding offer but a non-binding online catalog. By clicking the "Buy" button, you make a binding offer to purchase the items in the shopping cart.
2. The confirmation of the technical receipt of your order is sent via email to the address you provided, immediately after receiving the order. This confirmation of receipt does not yet constitute acceptance of your order.
3. A legally binding agreement for the purchase of the items you ordered is concluded upon acceptance of the order.
4. The Customer agrees that the order confirmation constitutes evidence of the establishment of the contractual relationship with AMT EXPORT.
5. Ownership of a product passes, notwithstanding the actual delivery, only to the buyer after the buyer has fully paid the payment due for that product, including interest and costs.
6. Agreements relating to items offered for sale on AMT EXPORT are concluded exclusively in Dutch and English.
7. The execution time for the order may vary for each product and depends on the number of ordered products and is clearly displayed on our website during the ordering process (among other things directly below the button to definitively confirm your order).
8. The agreement is concluded subject to the suspensive condition that the relevant products are available.

V. Payment

1. All prices of the Products are stated in Euro (net prices in Euro). Prices exclude VAT.
2. Payment is made by choice via advance payment (Direct bank transfer).
3. AMT EXPORT reserves the right to send its invoices only electronically (currently by email).
4. Ownership of the merchandise is reserved for AMT EXPORT until full payment of the purchase price.

VI. Delivery and Performance

1. We will exercise the utmost care in receiving and executing orders. The delivery times stated in quotations, offers, and on the website are indicative. No rights can be derived from this, and the deadlines are not final.
2. The place of delivery is the address you have provided to us. This can be done via the website or on the order form.
3. Deliveries take place in the country where the order is placed. If you wish delivery to take place in another country, we have the right to charge additional shipping costs.
4. We are entitled to make partial deliveries (partial deliveries), which can be invoiced separately.
5. We will execute accepted orders with due speed after the conclusion of the agreement, but no later than 30 days thereafter. If delivery is delayed beyond these 30 days, you will be notified as soon as we become aware of this. We are then in default when you put us in default with a reminder giving us a reasonable period to deliver and when performance still fails. Another delivery period can also be agreed or another product can be agreed upon.
6. If an order cannot be executed or can only be executed partially, you will be notified of this as soon as we become aware of it. You then have the right to terminate the agreement without costs.
7. In the event of termination pursuant to paragraphs 5 and 6, we will immediately refund any amounts already paid to us. You are not entitled to compensation.
8. If you refuse products or services or do not fulfill your delivery commitments, we have the right to terminate the agreement immediately or to dispose of the products immediately. The damages and/or costs incurred may be charged to you (e.g. transportation costs).

VII. Warranty

1. AMT EXPORT guarantees that the Products and/or services comply with the Agreement and the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the Agreement.
2. The warranty mentioned in this Article VII is equal to the manufacturer's warranty offered for the Products.
3. Defects in the items resulting from normal wear and tear or damage resulting from circumstances beyond the control of AMT EXPORT, including weather conditions or damage occurring during transport by the Customer, are excluded from the warranty.
4. Any form of warranty expires if the item has been used improperly or carelessly and/or if it has been incorrectly stored or maintained by the Customer and/or third parties.

VIII. Complaints Procedure

1. The Entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
2. Complaints about the performance of the Agreement must be submitted to the Entrepreneur fully and clearly described within a reasonable time after the Customer has discovered the defects.
3. Complaints submitted to the Entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the Entrepreneur will respond within the period of 14 days with a message of receipt and an indication of when the Customer can expect a more detailed answer. IX. Force Majeure

1. In case of force majeure, the obligations of AMT EXPORT are suspended. This non-performance of the contract does not entail any liability of AMT EXPORT. If the force majeure lasts longer than one (1) month, AMT EXPORT cannot execute the order and, in applicable cases, a refund will be made to the Customer for the relevant order.

X. Privacy Statement

1. The processing and protection of personal data are subject to a Privacy Statement, which is part of these general terms and conditions. Please read the Privacy Statement carefully.

XI. Other Provisions

1. The elements on the website of AMT EXPORT, including logos, registered trademarks, texts, photos, images, drawings, models, or tables, are works protected by intellectual property rights or personal rights. Therefore, reproduction or display of this website in whole or in part is prohibited without the prior express consent of the owners of these rights.
2. Only users are responsible for browsing the website: amtexport.eu. The Entrepreneur cannot be held responsible for defects, errors, or viruses that could endanger the continuity of access to its website, nor for the malfunctioning of users' computer installations, which could be detected after accessing the website. The Entrepreneur cannot, therefore, be held liable for compensation for direct or indirect damage that may result from the use of or access to the website, or from the downloading of elements stored on the website (images, texts, video files).
3. These General Sales Conditions are subject to Belgian law.
4. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and any other agreement between States are not applicable.
